Final Comment The SAHRA Archaeology, Palaeontology and Meteorites (APM) Unit cannot endorse this proposed development as an assessment of the impact on archaeological and palaeontological heritage resources has not been undertaken that complies with section 38(3) of the National Heritage Resources Act, Act 25 of 1999 (NHRA). SAHRA advises the Department of Mineral Resources and Energy (DMRE) to reject the application to extend its mining activities to include the two additional areas originally part of the Vunene Mining Right into the Mooiplaats Colliery. An Environmental Impact Assessment (EIA) Report was submitted to the case, along with its appendices. The applicant had failed to comply with the letter issued on the 16/10/2020 for the application and submitted only the EIA with no compliant assessment of the impact to heritage. As such, SAHRA is refusing to endorse the proposed extension of the Mining Right application as the assessment of heritage resources as part of the EA process as required by section 24(4)b(iii) of the NEMA, section 38(3) and section 38(8) of the National Heritage Resources Act, Act 25 of 1999 (NHRA).This comment must be forwarded directly to the competent authorities and proof of the submission and receipt thereof must be provided to SAHRA.
