The Heritage Officers Committee meeting considered your application on 23 August 2023 and the following was discussed.

  1. The committee noted the HIA was of poor standard as it did not consider all the archaeological finds in the area, and the practitioner quoted incorrect legislation, referenced the wrong heritage authority and was generally very badly compiled.  
  2. It was noted that previous studies were done by other heritage practitioners for sites nearby which the heritage practitioner had not referenced in the HIA. 
  3. It was noted that the proposal drawings had not been submitted and the impact on the graves of Moses Mabhida and Johnstone Makhathini was unclear.
  4. Therefore, the committee resolved to request for the following for further consideration:

  5. The applicant is required to revise the HIA to meet the standards as provisioned by Section 41(3) of the KwaZulu-Natal Amafa and Research Institute Act (Act 05 of 2018). 
  6. Drawings depicting the proposed development and a narrative as to how the proposal would affect the graves on site were required. 
  7. Failure to comply with the requirements of the National Heritgae Act and the KwaZulu-Natal Amafa and Research Institute Act would mean that no authorization will be given.
