Hillside Complex Proprietary Limited (Hillside Complex), previously known as Beethoven Investments Proprietary Limited is in the process of applying for a Section 24G application in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) for the unlawful commencement of activities associated with the National Environmental Management: Waste Act, 2008 (Act 54 of 2008) (NEMWA) at the Hillside Siding. Hillside Complex was granted an Environmental Authorisation (Ref. No.: 17/2/3/3N-46) and Water Use License (License No.: 06/B11K/G/6921) to operate Hillside Siding. Hillside Complex has submitted a Section 24 G application to the Department of Forestry, Fisheries and Environment in terms of NEMA for the unlawful commencement of the activities at the Hillside Siding without a Waste Management License in terms of the NEMWA. The following activities were undertaken in terms of the granted Environmental Authorisation and Water Use License: clearing of vegetation, development of stormwater management infrastructure, development of haul and access roads, pollution control dam and coal stockpiles (disposal of discard). The construction and operation of the pollution control dam, slurry dam and slurry drying pad was undertaken without the required Waste Management License. Hillside Siding is located on Portion 62 of the Farm Elandsdrift 291 JS, approximately 10km west of Middleburg Town and 23km northeast of eMalahleni Town within the Steve Tshwete Local Municipality, Nkangala District, Mpumalanga Province.
