    Proposal Description
    The purpose of this application is to submit the necessary land use applications to legalize the existing pig farm on a ± 3ha portion of Erf 7026, Kwanonqaba, Mossel Bay. This is in response to the Council Resolution taken on 19 January 2023 regarding this matter.

    In pursuance of the purpose/objective stated above, application is made, and authorisation is sought in terms of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021 (as amended) for the following:
    • Subdivision in terms of Section 15(2)(d) of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021, of Erf 7026 Kwanonqaba, Mossel Bay into two portions namely Erf A (±3ha in extent), and the remainder of Erf 7026, Kwanonqaba, Mossel Bay (as shown on PLAN 2: SUBDIVISION PLAN FOR ERF 7026 KWANONQABA).
    • Confirmation that the registration of a 13m wide Right of Way Servitude over Erf 1717 Kwanonqaba, Mossel Bay to ensure access to Erf A (±3ha ha in extent), a portion of Erf 7026 Kwanonqaba, Mossel Bay (as shown on PLAN 2: SUBDIVISION PLAN FOR ERF 7026 KWANONQABA) is exempt in terms of Section 24(1)(f)(iv) of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021.
    • Rezoning in terms of Section 15(2)(a) of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021, of Erf A (±3ha ha in extent), a portion of Erf 7026 Kwanonqaba, Mossel Bay from Open Space Zone II (OSZII) (Private Open Space) to Agricultural Zone I (AZ1) to be used for animal farming purposes.
    • A Permanent Departure in terms of Section 15(2)(b) of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021 (as amended) on the building lines of proposed Erf A (±3ha in extent), a portion of Erf 7026 Kwanonqaba, Mossel Bay as follows:
    o Reducing the Road/Street and Common Boundary (except for the common boundary with the industrial area) building lines from 10m to 5m.
    • Consent in terms of Section 15(2)(m) of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021, to use Portion A (±3ha ha in extent), a portion of Erf 7026 Kwanonqaba, Mossel Bay for Abattoir purposes to allow for the slaughter, preparation and distribution of animals to butcheries and other food market shops.
    • Consent in terms of Section 15(2)(m) of the Mossel Bay Municipality: By-Law on Municipal Land Use Planning, 2021, to use Portion A (±3ha ha in extent), a portion of Erf 7026 Kwanonqaba, Mossel Bay for Agricultural Industry (>2000m²) purposes to allow livestock auctions to take place on the property.
