Case Decision - 383424

Interim Comment:

The SAHRA Development Applications Unit (DAU) is making the following comments in terms of section 38(8) of the National Heritage Resources Act as contemplated by the EIA process in terms of section 24(4)b(iii) of NEMA:

• The field PIA report is not conclusive neither does it provide an impact assessment of the development on the identified Palaeontology.
• Furthermore, the report does not provide significance rating in terms of section 3(3) of the NHRA.
• The SAHRA DAU is therefore requesting the revision of the PIA report to specifically have the following clearly outlined:
  a) Field Survey Findings (compying with section 38(3)a of the NHRA).
  b) Palaeontological Heritage Significance (using the criteria set out in sections 3(3), 38(3)b in consultation with section 7 (NHRA) and the 2012 Minimum Standards: Palaeontological Components of Heritage Impact Assessments)
  c) Impact Assessment of the Proposed Activities on Findings (complying with the provisions of section 38(3)c-d
  d) Proposed Mitigation Measures (complying with section 38(3)f-g of the NHRA)
• The author is required to use the above as headings/titles on the report for coherency, comprehension and logical consideration.
